Terms of Service
1. Acceptance of Terms
These Terms of Service ("Terms") form an agreement between you and ArtstationX ("we", "us") governing your use of our subscription-based US server rental service. By registering an account, placing an order, or using the service, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy.
If you do not agree, do not register or use the service. If you accept these Terms on behalf of an organization, you represent that you are authorized to do so.
2. The Service
- We rent servers located in the United States on a subscription basis, including server access credentials, a traffic allowance, multi-device connections and subscription profiles;
- The price, term, traffic allowance, device limit and available nodes of each plan are those shown in the user panel at the time you order;
- We may add, adjust or retire individual nodes based on route quality, upstream supply or compliance requirements. Where this happens we will make reasonable efforts to keep overall capacity consistent with the plan you purchased;
- The service provides connectivity on an as-available basis and does not guarantee access to any particular website, application or third-party platform.
3. Accounts and Security
- You must provide a valid email address and keep your registration details accurate;
- You are responsible for all activity under your account; keep your password and subscription link confidential;
- A subscription link (token) is equivalent to an account credential. Publicly sharing, reselling or mass-distributing subscription links is a breach of these Terms;
- If you suspect unauthorized use, change your password, reset your subscription link and contact us immediately;
- Each user should hold one account. We may merge or close accounts used to claim repeated trials or promotions or to evade limits.
4. Subscriptions, Payment and Renewal
- Prices are those displayed at checkout in the stated currency and, unless noted otherwise, exclude taxes that may apply where you are located;
- An order is activated once the payment provider confirms funds; delays caused by the payment channel are not service downtime;
- When a subscription expires the service stops. Unused traffic does not roll over unless the plan states otherwise;
- If you enable auto-renewal, we will charge the then-current price before expiry. You may cancel auto-renewal at any time in the user panel or with the payment provider; cancellation takes effect from the next billing cycle;
- We may change prices. A change does not affect the term you have already paid for and applies from your next renewal;
- Account balance, where offered, may be used only to purchase our services and cannot be withdrawn or transferred.
5. Refund Policy
The service is a digital product that is activated immediately on payment and consumes node, bandwidth and account resources from that moment. All sales are final and no refunds are provided — this includes subscription plans, renewals, one-off traffic packs and top-ups, and account balance credit.
- Please confirm the price, term, traffic allowance and device limit of a plan before ordering; if anything is unclear, open a ticket first and we will answer honestly;
- No refund is given for reasons on your side, including ordering the wrong plan, duplicate orders, no longer needing the service, switching provider, or problems with your own network or devices;
- Accounts restricted, suspended or terminated for breaching Section 6 (Acceptable Use Policy) are not refunded;
- Account balance may be used only to purchase our services and cannot be withdrawn or transferred;
- Service fault compensation: if the service is unavailable for an extended period within a billing cycle due to our fault, we will provide additional subscription time or equivalent service compensation, not a cash refund.
Filing a chargeback without contacting us first entitles us to terminate the account immediately and pursue recovery. If you dispute a charge or the service, open a ticket first — nearly every issue can be resolved directly.
This section does not affect mandatory consumer rights under applicable law. Where your jurisdiction grants a non-excludable cooling-off period or statutory refund right, that law prevails.
6. Acceptable Use Policy
You agree not to use the service to:
- Send spam, bulk unsolicited messages, or conduct mail bombing of any kind;
- Launch or participate in DDoS attacks, port scanning, credential stuffing, exploitation or other intrusive activity;
- Access systems, accounts or data without authorization, or distribute malware, ransomware or trojans;
- Produce, store or transmit child sexual abuse material (CSAM), terrorist content, or other content unlawful across jurisdictions;
- Commit fraud, phishing, identity theft, money laundering or other financial crime;
- Infringe the copyright, trademark, patent or trade secret rights of others;
- Run large-scale automated scraping, order-faking, bulk registration or account farming that violates a target platform's rules and constitutes abuse;
- Resell, sub-distribute or commercially provide the service to third parties without our written authorization;
- Circumvent traffic metering, device limits or other technical controls.
We do not proactively monitor the content of your communications for moderation purposes, but on receiving a valid complaint, abuse report or upstream provider notice we may restrict, suspend or terminate the service as necessary.
7. Fair Use
To protect the experience of all users we apply fair-use management to abnormal consumption of shared resources:
- Plans described as "unlimited" or "high volume" remain subject to reasonable use for normal personal browsing;
- Sustained maximum-bandwidth usage, very high concurrency, outbound relaying or running public-facing services may result in rate limiting, node restrictions, or a request to move to a more suitable plan;
- Connections beyond your plan's device limit may be refused or dropped.
Where practical we will notify you by email or ticket before applying such measures.
8. Availability and Maintenance
- We work to keep the service continuously available but do not promise 100% uptime;
- Planned maintenance is scheduled during off-peak hours where possible and announced in advance by site notice or email;
- The following are not counted as downtime: faults in your own network or devices; network regulation or carrier restrictions in your region; blocking policies of third-party platforms; force majeure (natural disaster, war, large-scale outage, governmental action); and interruptions caused by your breach of these Terms;
- We may temporarily or permanently retire specific nodes due to upstream data centers, law, or security risk.
9. Suspension and Termination
- If you breach these Terms — Section 6 in particular — we may restrict, suspend or terminate your account without prior notice, and in serious cases without refund of amounts paid;
- You may stop using the service or delete your account at any time, in the app under Settings → About → Delete Account; deletion removes your subscription and related data irreversibly;
- If we decide to discontinue the service entirely, we will give at least 30 days' notice so that you can use your remaining time; unused subscription time is not otherwise refunded unless required by law.
10. Local Law Compliance
Rules on the use of network services differ by country and region. You are responsible for knowing and complying with all laws applicable where you are located and where you connect. You confirm that you use the service for lawful purposes — such as protecting communications privacy, remote work, and cross-border technical collaboration and testing — and that you bear the consequences of any breach of local law.
The service may not be used for purposes restricted by export controls or sanctions, nor by individuals or entities on applicable sanctions lists.
11. Intellectual Property
The interface design, documentation, trademarks, logos, client software and related code of ArtstationX belong to us or our licensors. We grant you a non-exclusive, non-transferable, revocable licence to use them for the purpose of using the service during your subscription term. Without written permission you may not copy, reverse engineer, redistribute, or build a competing product on the service.
The service may include third-party open-source components, which remain subject to their own licences.
12. Disclaimer
To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, continuity, error-free operation, or any specific speed or latency. Network performance depends on routes, carriers, destination sites and your local environment.
13. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, punitive or consequential damages, including lost profits, lost data, business interruption or reputational harm;
- Our aggregate liability under these Terms is capped at the amount you actually paid us for the service in the 3 months preceding the event giving rise to the claim;
- These limits do not apply to our wilful misconduct or gross negligence, nor exclude liability that cannot be excluded by law.
14. Indemnification
You will indemnify and hold us harmless against any claim, loss, penalty or expense (including reasonable legal fees) arising from your breach of these Terms, misuse of the service, or infringement of third-party rights.
15. Changes to These Terms
We may revise these Terms from time to time. Revisions are posted on this page with an updated effective date, and material changes are announced in advance by email or site notice. Continuing to use the service after a change takes effect means you accept the revised Terms; if you do not accept them, you may stop using the service and close your account, but under Section 5 amounts already paid are not refunded.
16. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which the ArtstationX operating entity is registered, without prejudice to mandatory consumer protections available to you where you live.
Any dispute arising from these Terms or the service should first be resolved through good-faith discussion — please contact us by ticket or email, and we commit to reviewing every dispute seriously. If discussion fails, either party may bring the dispute before a competent court in the jurisdiction where the operating entity is registered.
If any provision is held invalid or unenforceable, the remaining provisions stay in full force.
